Terms of Service

Welcome to CrewTap, operated by Lightbox Studios LLC ("we", "us", "our"). By using the CrewTap mobile application and related services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

CrewTap is a technology platform that facilitates introductions between independent landscaping contractors ("Contractors") and independent skilled landscaping pros ("Pros"). CrewTap is not a staffing agency, labor broker, or employer of Pros.

Important: CrewTap solely provides a communication tool. We do not employ, dispatch, supervise, or control Pros. Any working arrangement, including scheduling, compensation, and terms of engagement, is made directly between Contractors and Pros. CrewTap is not a party to any such arrangement.

2. Eligibility

You must be at least 18 years old and legally authorized to conduct business in the United States to use the Service. Contractors must hold any licenses required by their jurisdiction to operate a landscaping business.

3. Accounts

You are responsible for maintaining the security of your account credentials. You agree to provide accurate, current, and complete information during registration and to update it as needed. You are responsible for all activity under your account.

4. Subscription and Payments

Contractors access the Service through a paid subscription at the current rate displayed in the app. Subscriptions are billed monthly and renew automatically unless canceled. Payments are processed through Apple In-App Purchase or Stripe. Refund policies follow the applicable payment processor's terms.

We reserve the right to change subscription pricing with 30 days' notice.

5. How the Service Works

For Contractors: You browse Pro profiles, select a Pro, and initiate a hire request. CrewTap sends an SMS to the Pro with your name, the job's general city area, the requested date, and your phone number. The Pro may accept or decline. If accepted, you and the Pro communicate directly to arrange the work.

For Pros: Pros are onboarded by CrewTap administrators and receive SMS notifications when a Contractor is interested in hiring them. Pros reply YES/SI to accept or NO to decline. Declining a request is always permitted and carries no penalty.

6. Independent Contractor Relationship

Pros listed on CrewTap are independent professionals. They are not employees, agents, or representatives of CrewTap or of Contractors who use the platform. CrewTap does not:

7. Job Site Safety and Insurance

Contractors are solely responsible for job site safety and compliance with all applicable laws, including workers' compensation requirements.

CrewTap facilitates introductions only. By using the Service to connect with a Pro, you acknowledge and agree that:

California law may require contractors to carry workers' compensation insurance for individuals performing work on their behalf. Failure to carry required coverage may result in civil and criminal penalties. CrewTap strongly encourages all Contractors to consult with a licensed insurance professional regarding their coverage obligations.

To maintain platform quality, Pros who are consistently unreachable (5 consecutive unanswered notifications) may be deactivated. Pros who confirm a job but fail to appear (no-show) may be deactivated after 2 occurrences. Declining a request (replying NO) is always permitted and resets the unreachable counter.

10. Ratings and Reviews

Contractors may rate Pros after a completed introduction. Ratings are used to help other Contractors make informed decisions. We reserve the right to remove ratings that violate these Terms or contain inappropriate content.

11. SMS Communications

Program Name: CrewTap Job Notifications

Program Description: CrewTap sends SMS messages to Pros when a Contractor initiates a hire request through the CrewTap app. Messages include the Contractor's name, the job's general city area, the requested date, the skill needed, and the Contractor's phone number so the two parties can communicate directly. Pros may also receive status update messages such as cancellation or expiration notices.

Opt-In: Pros consent to receive SMS messages by (a) providing their phone number and checking the SMS consent checkbox on the CrewTap signup form at crewtap.app/signup, or (b) providing verbal and written consent during an in-person onboarding session with a CrewTap administrator. Consent is not a condition of any purchase. Only Pros who have explicitly opted in will receive messages.

Message Frequency: Varies based on hire request activity (estimated 1–10 messages per week).

Message and data rates may apply. Contact your wireless carrier for details about your text messaging plan.

To opt out: Reply STOP to any message to stop receiving SMS notifications. You will receive a one-time confirmation message. No further messages will be sent unless you re-subscribe by replying START.

Supported Carriers: AT&T, Verizon, T-Mobile, Sprint, and most major US carriers. Carriers are not liable for delayed or undelivered messages.

12. Limitation of Liability

CrewTap provides the Service "as is" without warranties of any kind. We are not liable for:

To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Lightbox Studios LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your interactions with other users.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may cancel your account at any time by contacting us at support@crewtap.app.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Santa Clara County, California.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or in-app notification.
